1. About these terms

These Terms of Service apply when a person accesses or uses volantero.com or purchases products from Volantero.

The store is operated by GCL Ventures LLC, a Kentucky limited liability company trading as Volantero.

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified, including those provided under the Australian Consumer Law.

If these terms conflict with a mandatory provision of applicable law, the mandatory provision prevails.

2. Eligibility and information supplied

Customers must be legally capable of entering into a contract.

Information supplied when creating an account or placing an order must be complete, current and accurate. Customers should update us promptly if their information changes or if an error is discovered.

Customers are responsible for taking reasonable steps to safeguard their account credentials and for activity carried out through their account, except to the extent that the activity results from our failure to take reasonable care.

3. Product information and availability

We aim to describe and display our products accurately, including their materials, colours, sizes, fit and key features.

Screen settings, lighting conditions and photography may cause colours to appear slightly different. Measurements are approximate unless expressly stated otherwise. These qualifications do not permit a materially inaccurate product description and do not limit the requirement that products match their description, images, sample or model as required by law.

Terms such as “leather-look”, “suede-look”, “wool-look” or similar describe the appearance of a product. They do not mean the product contains those materials unless the product composition expressly states that it does.

We may correct genuine errors and update product information. We will not substitute a materially different product without the customer’s agreement.

All products are subject to availability.

4. How a contract is formed

Our checkout allows customers to review and correct their order before submitting it.

Placing an order constitutes an offer to purchase the selected products. After an order is submitted, we normally send an automated order acknowledgement. This acknowledgement confirms that we have received the order but does not, by itself, mean that we have accepted it.

Unless we expressly confirm acceptance earlier, a contract is formed when we send the customer a dispatch confirmation.

We may decline an order before acceptance for legitimate reasons, including:

  • Unavailable stock

  • An obvious pricing or product-information error

  • Delivery restrictions

  • Failed or unauthorised payment

  • Reasonable fraud or security concerns

If payment has already been collected for an order we do not accept, we will refund the amount paid using the original payment method.

Nothing in this section permits us to mislead customers about product availability or pricing, or to avoid a contract that has already been accepted where doing so would be unlawful.

5. Prices, taxes and payment

All prices are displayed in Australian dollars (AUD).

The displayed total price includes any applicable taxes, duties and unavoidable or pre-selected charges that Volantero requires the customer to pay and that can be calculated when the price is displayed.

Before an order is submitted, checkout displays the selected products, any applicable charges and the total amount payable. Standard delivery within Australia is free.

6. Delivery and risk

We deliver to Australian addresses using the delivery methods and estimates stated in our Shipping Policy.

Risk of loss or damage remains with us until the products are delivered to the customer or to a person authorised by the customer to receive them.

Delivery dates are estimates unless we expressly agree to a guaranteed delivery date.

If an event genuinely beyond our reasonable control causes a material delay, we will provide updated information as soon as reasonably possible. If we cannot supply an order within a reasonable period and the customer does not accept the revised timeframe, the customer may cancel the affected order and receive a refund.

Nothing in this section limits any right or remedy available under the Australian Consumer Law.

7. Returns, refunds and consumer guarantees

Our Return and Refund Policy explains our voluntary 30-day change-of-mind return promise and the remedies available when a product does not comply with a consumer guarantee. That policy forms part of these terms.

Our voluntary change-of-mind policy applies in addition to, and does not replace or restrict, rights and remedies under the Australian Consumer Law.

Depending on the circumstances, statutory remedies may include a repair, replacement, refund, cancellation or compensation for reasonably foreseeable loss.

8. Acceptable website use

The website may only be used for lawful purposes.

Users must not:

  • Interfere with the website’s security, availability or operation

  • Introduce malicious code or other harmful technology

  • Access or misuse another person’s account

  • Use the website to commit or facilitate fraud

  • Collect or scrape website data in breach of applicable law

  • Infringe intellectual-property, privacy or other legal rights

  • Use automated systems in a manner that places an unreasonable burden on the website

We may restrict or suspend access where reasonably necessary and proportionate to protect customers, the website, other users or our legal rights.

9. Intellectual property

Unless otherwise identified, the website design, original text, graphics, photographs, logos and other original content belong to or are licensed to GCL Ventures LLC.

Visitors may access, view and make ordinary personal use of the website. No other licence is granted except where expressly stated or required by law.

Third-party names, trademarks and other intellectual property remain the property of their respective owners.

10. Reviews and customer content

Reviews and other content submitted to us must be honest, lawful and based on a genuine experience. Submitted content must not infringe another person’s rights, contain malicious code, or include unlawful, deceptive, threatening or abusive material.

By submitting content for publication, the customer grants GCL Ventures LLC a non-exclusive, worldwide and royalty-free licence to host, reproduce and display that content for the purposes of operating and promoting Volantero.

The customer retains ownership of their original content.

We may moderate or remove content that is unlawful, deceptive, abusive, irrelevant or otherwise violates these terms. We will not selectively edit, suppress or manipulate customer reviews in a way that creates a misleading impression.

11. Third-party services and links

Our website may contain links to independent third-party websites or services. We are not responsible for content, products or transactions provided independently by those third parties.

This does not exclude responsibility that applicable law places on us for service providers or carriers we select to perform our obligations.

Our online store is hosted by Shopify. Products purchased through the store are sold by GCL Ventures LLC, trading as Volantero, and not by Shopify.

12. Our responsibility

We do not exclude or limit liability where doing so would be unlawful. This includes liability arising under non-excludable Australian consumer guarantees and liability for fraud or wilful misconduct.

Subject to applicable law, we are responsible for loss or damage that is a reasonably foreseeable result of our breach of these terms or failure to exercise reasonable care.

We are not responsible for losses caused solely by events genuinely beyond our reasonable control where we have taken reasonable steps to prevent or minimise their effects.

Products offered through the store are generally intended for personal or household use. To the extent permitted by law, we are not responsible for business losses that were not reasonably contemplated when the contract was formed.

Nothing in this section limits any mandatory consumer right or remedy, including a right to compensation for reasonably foreseeable loss under the Australian Consumer Law.

13. Privacy

Our collection, use, storage and disclosure of personal information are explained in our Privacy Policy.

14. Governing law and disputes

These terms are governed by the laws applicable in Victoria, Australia.

This choice of law does not deprive a customer of any mandatory protection available under the laws of their Australian state or territory.

Customers should contact us first so we can attempt to resolve a complaint directly. Customers remain free to:

  • Contact an applicable state or territory consumer-protection agency

  • Obtain independent legal advice

  • Use any dispute-resolution process available to them

  • Bring a claim before a tribunal or court with jurisdiction

Nothing in these terms requires a customer to waive a legal right or use a particular dispute-resolution process before exercising a right available under law.

15. Changes to these terms

We may update these terms prospectively for legal, operational or security reasons.

The version that normally applies to an order is the version made available when that order was placed. Changes will not retrospectively remove rights or materially alter an accepted order without the customer’s agreement, except where required by law.

We will provide additional notice of material changes where required.
